Distance Sales Agreement
1- Parties
ANT GÖKHAN SEYAHAT TURİZM TAŞIMACILIK KONAKLAMA OTOMOTİV İNŞAAT PETROL TİC. LTD. ŞTİ, hereinafter referred to as "TRANSFER7.com".
2- Subject
With this agreement, the parties agree to the terms outlined below for the provision of one-way or round-trip transfers from designated addresses to airports and vice versa, or between locations offered by "TRANSFER7.com," as well as for the provision of daily tour/excursion services, all to be performed by TRANSFER7.com in exchange for a fee.
3- Service and Payment Details**
3.1. The agreement amount includes VAT.
3.2. The agency may replace the type of vehicle with one of the same segment if necessary, by notifying the consumer. For example, replacing a Mercedes Vito with a Volkswagen Caravelle. If the customer does not accept such a change at the time of reservation, they may cancel the reservation and receive a full refund. In this case, the customer has no right to claim compensation.
4- Transfer Type: One-Way (Single/Double Trip)
5- Vehicle Type: The vehicle type selected by the customer (Mini Van - Minibus).
**6- Number of Passengers:** The customer must specify the number of passengers.
**7- General Provisions**
Passengers are required to wear seat belts according to the Traffic Law.
To use the transfer service in this agreement, the customer must make a reservation at least 24 hours prior to the transfer time. During religious or national holidays, New Year, and other official holidays, reservations must be made at least 48 hours in advance. The reservation may be canceled by the customer up to 24 hours before the transfer time, and in such cases, the customer will be refunded. For cancellations made after this deadline, no refund will be issued. The route to be followed from the departure point to the arrival point during the transfer will be determined solely by "TRANSFER7.com," taking into account traffic, road conditions, and other criteria. The customer has no authority to alter this route. Any request for a stopover or a short wait at a different location along the specified route will be accommodated. TRANSFER7.com is responsible for transporting the passenger to a specified point between two designated locations.
"TRANSFER7.com" does not accept sacks, crates, boxes, or similar items as baggage during the transfer. Each passenger is allowed a maximum of 15 kg of baggage. In case of loss or damage to baggage without a declared value, the customer has no right to claim financial or moral compensation. The customer accepts, declares, and undertakes that there are no flammable, explosive, narcotic, liquid, odorous, radioactive, or otherwise legally prohibited substances in their baggage. If the driver detects any prohibited substances in the baggage, such baggage will not be accepted into the vehicle. No refund will be issued if the transfer is delayed or missed due to the removal of such substances from the baggage, exceeding the 15-minute waiting time, or if the customer misses their flight due to this delay. Furthermore, in such cases, the customer cannot claim any payment or rights from TRANSFER7.com. If prohibited substances are discovered in the baggage, "TRANSFER7.com" will immediately report this to the relevant authorities. If prohibited items are not detected by the driver but are found by law enforcement during the transfer, the customer will be liable for any damages incurred by "TRANSFER7.com," to be paid in full and immediately. Requests for the transfer of pets and the type of pet to be transferred must be specified by the customer during the online booking process. Pets will not be transferred without prior notification. Pets cannot be transferred alone without an adult present. The pet to be transferred may only be transported, entirely at the customer's responsibility, in a special cage placed in a designated area inside the vehicle. Animals whose ownership, possession, or transfer is prohibited under Turkish law cannot be transported under any circumstances.
For transfers from a specific location to the airport, TRANSFER7.com commits to having the vehicle at the specified location at the scheduled time. A delay of up to 20 minutes will be considered reasonable. In case of a delay exceeding 20 minutes, the customer is not obliged to wait for the vehicle, and the transfer fee will be refunded. In locations such as sites or residential complexes where the security personnel prevent the vehicle from entering, TRANSFER7.com is not responsible for any delays exceeding the 15-minute waiting time. If the customer decides not to wait due to such delays, no refund will be issued. The customer must be ready at the designated transfer point with their baggage at the scheduled transfer time. If the customer is not present at the transfer point at the scheduled time, the vehicle assigned by TRANSFER7.com is only obliged to wait for 15 minutes. If the customer does not arrive with their baggage within 15 minutes, the vehicle is not required to wait any longer.
TRANSFER7.com personnel are not required to leave the vehicle to carry baggage, pet cages, or accompany the passenger to the vehicle. Children under 12 years old will not be transferred without an accompanying adult. If a return transfer is required for the accompanying adult, this service must be purchased on the website. If a wheelchair transfer is required along with the passenger, this must be specified by the customer during the online booking process.
If requested by the customer during the online booking, one child seat may be provided inside the vehicle for 200 TL or 5 € by TRANSFER7.com.
8- Force Majeure
If either party is unable to fulfill its obligations under this agreement due to any force majeure, natural events, adverse weather conditions, social or public events, negative developments in the labor market, legal or illegal actions by workers or employers, strikes, lockouts, union actions, work slowdowns, wars, armed conflicts, revolutions, martial law or states of emergency, intergroup conflicts, or uprisings, the agreement will remain suspended until these circumstances or adverse effects are resolved. Once these conditions or adverse effects are resolved, the agreement will resume. Force majeure does not entitle either party to terminate the agreement or claim compensation.
9- Cancellation Terms and Other Provisions
For promotional products purchased by the passenger, no cancellation, changes, or refunds are allowed for any reason. Cancellations and refund requests for expired reservations are invalid for requests submitted to the bank or "TRANSFER7.com."
10- Jurisdiction
Turkish law will apply to all disputes arising from the implementation of this agreement, and Antalya Courts and Enforcement Offices will have jurisdiction.
11- Validity
Passengers who receive the services covered by this agreement but are not signatories to the agreement are deemed to have accepted the terms by making an online reservation through a third party on their behalf. In case of disputes arising from the agreement, the provisions of Law No. 4925 on Road Transport and other relevant Turkish legislation will apply. Antalya courts and enforcement offices have jurisdiction. I have read, understood, and accepted the entirety of this agreement, including the departure date and time, Law No. 4925 on Road Transport, and the information on the website, and have received a copy.
Every user making a reservation through www.transfer7.com is deemed to have read and accepted this agreement.
